Online sales

Online items purchased and ordered through Active Mobility Systems may be delivered in original packaging and may require some form of assembly to the product. Extra charges will apply for product pre-assembly, delivery and product usage training carried out by qualified Active Mobility Systems sales or delivery staff. Delivery may be carried out by a courier or postal service of Active Mobility’s choice to the delivery address supplied by you to us. By accepting these terms, you agree irrevocably to appoint and do appoint the courier or postal service to be your agent for taking delivery of the Products on your behalf, and delivery to the courier or postal service shall be deemed to be delivery to you.

All delivery is subject to availability and time shall be of the essence. If there is any delay in delivery, we will notify you of this and give you a new delivery time. As we process your order, we will also notify you if any products are not available.

Delivery and Availability

Active Mobility shall deliver products ordered by you to a courier or postal service of Active Mobility’s choice to the delivery address that you have given us. By accepting these terms, you agree irrevocably to appoint and do appoint the courier or postal service to be your agent for taking delivery of the Products on your behalf, and delivery to the courier or postal service shall be deemed to be delivery to you.

Standard Delivery Within Australia

You will receive your order in approximately 2-3 working days and it costs $20.00 + GST [i.e. $22.00] per order for shipping and handling within Australia. If you purchase multiple items at one time additional charges may apply depending on total weight – you will be advised prior to despatch if this is the case. We do our best to ship in the times quoted and faster if possible‚ but sometimes deliveries can be delayed beyond our control. When your product is dispatched you will receive an email containing a consignment number and tracking instructions. This number will allow you to track the progress of your parcel.

Please note that parcels shipped to WA and remote areas may take an additional 1-2 days to deliver. We can deliver to PO boxes.

Inspection, Delivery Delays and Non-Delivery

Nothing in this clause affects your statutory rights pursuant to the provisions headed "Right to Cancel and Returns" below.

You must inspect the products as soon as is reasonably practicable after delivery. Within 2 days of delivery you must notify Active Mobility in detail and in writing of any defect in the products or of any other complaint that you may have in relation to the products. If you fail to give notice in accordance with this clause, the products shall be conclusively presumed to be in all respects in accordance with the order and free from any defect that would be apparent on reasonable examination, and you shall be deemed to have accepted the products accordingly.

Subject to the conditions set out below, if you establish to our reasonable satisfaction that any Products are not in accordance with these Terms or any other contract between us or are defective, your sole remedy shall be limited (as Active Mobility may elect) to the replacement of the products or refund to you of the purchase price and any delivery costs or, where sums are owed by you to us, the issue of a credit card account refund against return of the products. If we require you to return the products to us and they are defective we shall reimburse your reasonable postage cost of returning them. These remedies are subject to the following conditions:

  • The claim is made in writing to Active Mobility within two (2) days after the order is received
  • The products to which the claim relates are returned to Active Mobility within that period suitably packaged and carriage-paid and, where relevant, in accordance with any particular instructions that we may have notified to you at the time of supply. Returned products or parts must be accompanied by an advice note stating the Identifying Number and the nature of any claimed defect, together with such further information as Active Mobility may at the time of supply have stipulated.
  • Sale items are final and not returnable.

Passing of Risk and Property

Risk of loss or damage to, and title to, the products shall pass to you at the time of delivery of the products to the courier or postal service as described under "Delivery" above.

Right to Cancel and Returns

If you are wishing to return products because they have been supplied incorrectly or are faulty please see the "Inspection, Delivery Delays and Non-Delivery" paragraph above. Active Mobility will not accept the return of products for any other reason – please choose carefully. Incorrectly supplied or faulty goods must be returned in original packaging and in original condition as received. Used products cannot be returned unless there is a manufacturing fault. Customers are responsible for shipping and handling costs for any returns. There will be no re-delivery fee on the replacement of incorrect or faulty goods.

Sale items are final and not returnable.

Exchange

For change of size, colour or style, requests need to be made in writing to our customer service team (sales@activemobility.com.au). These will be treated on a case by case basis, subject to availability of exchange item and normal stock status of supplied item. Active Mobility does not guarantee that your exchange will be granted. A re-delivery fee will be applicable for exchange goods.

No exchange on Sale items.
